Não basta ser apoiador ou cabo eleitoral voluntário para um candidato ou partido na campanha eleitoral. Esse e outros pontos foram tema do Berlinda News Entrevista de hoje (22) com a participação de Sérgio e Andreza Dienstmann, da Percon Contabilidade. Até o dia 25, domingo, candidatos e partidos precisam fazer e enviar à Justiça Eleitoral a 1ª prestação parcial de contas.
Sobre o cabo eleitoral voluntário a legislação tem regras. “Precisa ter um termo estimável de pagamento e os dois (voluntário/candidato) firmam contrato explicando que está doando um valor estimável pelo serviço, que está prestando um trabalho como panfletagem ou bandeiraço, por exemplo. Precisa detalhar quando vai fazer este serviço, onde e por quanto tempo. Tem que ser tudo detalhado e especificado. Agora, caso haja o pagamento deste trabalho, tem que ser feito então um contrato de serviço”, orienta Andreza.
Sérgio alerta. “Todos os candidatos, independentemente de estarem com o registro deferido ou não, deverão encaminhar as informações por meio do Sistema de Prestação de Contas Eleitorais (SPCE)”, observa. Confira os principais s pontos importantes sobre este assunto tratados durante o programa.
Transparência
“Em primeiro lugar é preciso ter transparência nas contas. Campanha eleitoral é conta pública. Não é complicado, é só fazer a coisa certa. E nós precisamos prestar contas para os eleitores e a sociedade que quer ver transparência”, Sérgio Dienstmann.
“Após o encaminhamento dos dados, as informações ficam à disposição de todos no site DivulgaCand, onde tem as receitas e despesas dos candidatos”, Andreza Dienstmann.
Como funciona
“Estamos com mais de vinte candidatos e trabalhamos com uma plataforma na qual fazemos todos os lançamentos e o candidato consegue acompanhar. Depois tudo isso é transmitido para o SPCE, que é os sistema da justiça eleitoral”, Andreza Dienstmann.
“Todo recurso que entra na conta do candidato, nós temos 72 horas para encaminhar a informação para o tribunal. Precisamos fazer o trabalho de recibos, fazer o registro na plataforma e fazer esse encaminhamento. Ou seja, é um trabalho que realmente precisa ser feito por uma equipe de contabilistas que tenham experiência na área eleitoral, porque são muitos detalhes que precisa estar atento”, Sérgio Dienstmann.
O que e porque declarar?
“Até o dia 25 vão começar a entrar as despesas, também, não só os ganhos. Como está sendo usado este valor? No que está sendo gasto? Temos que especificar item por item no que foi gasto na nota. Os santinhos, por exemplo, é necessário discriminar a quantidade, o tamanho e quem é o candidato. E depois a comprovação não é só a nota fiscal, é o recebimento do material, também. Alguns Estados não estão olhando isso ainda, mas outros já pedem a materialidade do fato. E o que é isso? É o recebimento do produto que ele mandou fazer junto com a nota fiscal. Porque o que acontecia em outras eleições era que o candidato chegava em uma gráfica, encomendava 100 mil santinhos, emitia a nota, pagava e o santinho mesmo não aparecia, ou seja, lavagem de dinheiro”, Sérgio Dienstmann.
Organização e Planejamento
“Você obrigatoriamente precisa ter um contador e precisa ter um advogado. Quando você entra para uma campanha, já sabe que terá uma despesa. Muitos, por exemplo, devem estar esperando receber o dinheiro do partido, mas quando vai vir esse dinheiro? Nem o partido não disse ainda. Entrou na campanha esperando o dinheiro do partido, mas tem que fazer prestação de contas e quem vai pagar? O planejamento de campanha é importante e mostrar esse planejamento para a equipe de trabalho é mais importante ainda”, Sérgio Dienstmann.
Irregularidades
“Todo dia tem o painel eletrônico do tribunal mostra as irregularidades. Por isso, é importante o advogado ter uma procuração e estar registrado para poder ver os processos que tem. E tem que olhar todos os dias, porque só tem 3 dias para o candidato se manifestar. E se a prestação de contas não estiver aprovada, o candidato não entra”, Sérgio Dienstmann.
Trabalho do contabilista
“A prestação de contas do candidato não termina no dia 15 de novembro. Ela termina quando a justiça eleitoral aprová-la. Ainda é necessário também fazer uma prestação para a Receita Federal. O candidato tem também que fazer o encerramento do CNPJ. Se fizer tudo certinho, nosso trabalho como contador só vai terminar no início do ano que vem. Agora, para que isso aconteça é preciso que o candidato e a sua equipe nos ajude. Porque não vamos colocar o nosso trabalho em jogo por falta de comprometimento do candidato. Neste caso, podemos reincidir o contrato”, Sérgio Dienstmann.
Vaquinha Virtual Eleitoral
“A vaquinha, logo depois que você doa, o site já entrega o recibo padrão eleitoral. Não tem como doar sem se identificar, até porque depois o doador também vai ter que declarar”, Andreza Dienstmann.
